A DUI arrest in Florida is a serious matter, and in addition to possible jail time, a number of fines are involved. The degree of severity of these fines is dependent on whether you face a first conviction or whether you have been previously convicted. Fines and penalties are also heightened if you have a blood alcohol content (BAC) above .15, or by having a minor in the vehicle at the time of your Florida DUI arrest.
First Time DUI Conviction
A first DUI arrest in Florida with a BAC of between 0.08 and 0.15 carries a minimum fine of $500, and a maximum fine of $1,000. If your BAC is above 0.15, or if there was a minor in the vehicle at the time of arrest, conviction carries a minimum fine of $1,000, and a maximum fine of $2,000. Additionally, 50 hours of community service may be ordered, which can be paid for at a rate of $10 for each hour.
Second Time DUI Conviction
A second DUI arrest in Florida with a BAC of between 0.08 and 0.15 carries a minimum fine of $1,000, and a maximum fine of $2,000. A BAC of more than 0.15, or a conviction where a minor was present in the vehicle has a minimum fine of $2,000, and a maximum fine of $4,000.
Third Time DUI Conviction
A third DUI arrest in Florida with a BAC of between 0.08 and 0.15 carries a minimum fine of $2,000, and a maximum fine of $5,000. In cases where the BAC is greater than 0.15, or where a minor was present in the vehicle, the minimum fine is $4,000, and there is no maximum fine.
Fourth Time DUI Conviction
A fourth DUI arrest in Florida results in a minimum $2,000 fine, with no upper limit, regardless of the BAC at the time of arrest. In addition, a conviction will result in the lifetime revocation of a driver’s license, and up to 5 years in jail.
